Thomas Jane, star of "The Punisher" was busted by cops for driving under the influence early Monday morning.

Jane, the husband of Patricia Arquette, was pulled over for speeding in California when police say they realized the 39 year-old actor had been drinking.

He cited for driving on a suspended license. Thomas was also charged with DUI.

Jane was driving with a blood alcohol level above .08 per cent, according to TMZ.com. His arraignment has been set for April 9th.
